Please read these Terms of Service ("Terms") carefully before using the ZodAI mobile application ("App") operated by Rico Schurter ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

ZODAI IS PROVIDED SOLELY FOR ENTERTAINMENT AND PERSONAL INSIGHT PURPOSES. ALL ASTROLOGICAL READINGS, INTERPRETATIONS, COMPATIBILITY ANALYSES, AND AI-GENERATED CONTENT ARE FOR ENTERTAINMENT PURPOSES ONLY AND ARE NOT INTENDED TO BE, AND SHOULD NOT BE CONSTRUED AS, PROFESSIONAL, MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, FINANCIAL, INVESTMENT, LEGAL, OR ANY OTHER TYPE OF PROFESSIONAL ADVICE.

You must be at least 13 years of age to use ZodAI. If you are between 13 and 18, you may use ZodAI only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
The App enforces age verification at registration using your date of birth. If you are under 13, your account will not be created. By using ZodAI, you represent that you meet the applicable age requirement.
ZodAI offers the following premium plans, managed through the Apple App Store:

New subscribers may be eligible for a 7-day free trial before their first billing period. Conditions:
MONTHLY AND ANNUAL SUBSCRIPTIONS AUTOMATICALLY RENEW UNLESS AUTO-RENEWAL IS TURNED OFF AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD. YOUR ACCOUNT WILL BE CHARGED FOR RENEWAL WITHIN 24 HOURS PRIOR TO THE END OF THE CURRENT PERIOD AT THE THEN-CURRENT SUBSCRIPTION RATE. THE LIFETIME PLAN IS A ONE-TIME PURCHASE AND DOES NOT RENEW.

Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused subscription time, except as required by Apple's refund policies.
All purchases are processed by Apple. Refund requests must be submitted to Apple at reportaproblem.apple.com. ZodAI has no control over Apple's refund decisions.

You agree not to use ZodAI to:
We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
All content, design, code, trademarks, logos, AI prompts, and interfaces of ZodAI are the exclusive property of Rico Schurter or our licensors. Nothing in these Terms grants you any ownership or license except the limited right to use the App for personal, non-commercial purposes.
You may not copy, reproduce, modify, distribute, display, or sublicense any part of ZodAI without our prior written permission.
You retain ownership of the personal information you provide (name, birth data, messages). By submitting content to ZodAI, you grant us a limited, non-exclusive, royalty-free license to process that content solely to provide the App's services to you.
We do not use your messages or birth data to train AI models. See our Privacy Policy for full details.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. ASTROLOGICAL CONTENT HAS NO SCIENTIFIC BASIS FOR PREDICTING FUTURE EVENTS, PERSONALITY TRAITS, OR LIFE OUTCOMES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RICO SCHURTER AND ZODAI ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO ZODAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.00 USD.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Rico Schurter and ZodAI from any claims, liabilities, damages, costs, and fees (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the App in an unauthorized manner, or your violation of any third party's rights or applicable law.
Before initiating formal proceedings, contact us at support@zodai.io with a written description of the dispute. We will attempt to resolve it within 30 days.
For users located in the United States: if informal resolution fails, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. This applies to disputes arising from breach of contract, warranty, fraud, misrepresentation, or any other legal theory.
US USERS WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR REPRESENTATIVE PROCEEDINGS. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.
You may opt out of arbitration by emailing support@zodai.io within 30 days of first using ZodAI with the subject "Arbitration Opt-Out."
For users outside the United States, disputes shall be resolved by the competent courts of Bellinzona, Canton Ticino, Switzerland, pursuant to Swiss law. EU/EEA consumers may also rely on mandatory consumer protection laws in their country of residence and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Any claim must be filed within one (1) year of the date the claim arose, regardless of any contrary statute of limitations.
These Terms are governed by the laws of Switzerland, without regard to conflict of law provisions. For non-arbitrated matters, the exclusive jurisdiction shall be the courts of Bellinzona, Canton Ticino, Switzerland.
EU/EEA/UK consumers may also rely on the mandatory consumer protection laws of their country of residence. The UN Convention on Contracts for the International Sale of Goods does not apply.
You may delete your account at any time via Profile → Delete Account. Deletion is permanent and immediate. Cancel active subscriptions separately through Apple to avoid continued billing.
We may suspend or terminate your access immediately, without notice, for violation of these Terms, fraudulent or illegal behavior, or misuse of the App. No refund will be provided upon termination for cause.
Upon termination, your right to use the App ceases immediately. Sections covering entertainment disclaimer, AI disclosure, intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.
When we make material changes, we will update the "Last updated" date and notify you via email or in-app notification at least 15 days before changes take effect. Continued use after the effective date constitutes acceptance.
